Frequently Asked Questions

The world of intellectual property is rich but complex. The PatentAgency.ca aims to make it accessible to all its potential customers, whether they are SMEs or inventors only, agents at medium or large companies who have a portfolio of patents or foreign agents from other countries that have several customers seeking to file their applications in Canada.

When it comes to the intangible assets of a company, the most important is its innovation, which can take the form of an invention (function of a product or service, including software and business methods), or design (aesthetics of a finished article or a graphic interface). Often requiring a significant investment of time, effort and money, these assets can be copied by competitors and consequently, lose a fortune to any company that neglects to acquire the rights and title of their intellectual property for their innovation in the form of a patent or industrial design.
The «Ministère du Développement économique, de l’Innovation et de l’Exportation» of Québec launched the Premier brevet program in the fall of 2015 to increase the number of Quebec companies protecting their intellectual property assets.

Under this program, any company with 250 or fewer employees who wishes to protect their assets, including through patents or industrial designs, may be eligible to benefit from a non-repayable government contribution of up to $25,000.

This is an excellent program and the PatentAgency.ca invites interested companies to be informed. The firm gives information sessions on this subject on a regular basis.

The Canadian Intellectual Property Office defines the main types of intellectual property as follows:

  • Industrial designs refer to the visual characteristics of the shape, pattern, pattern or decorative elements, or any combination of these features, of a finished object.
  • The patents cover inventions (product, composition of materials, apparatus, process) as well as any improvement of an existing invention presenting the character of novelty and utility.
  • Trademarks may consist of one or a combination of words, sounds or designs used to distinguish the goods or services of one person or organization from those of others.
  • Copyright protects literary, artistic, dramatic or musical works (including computer programs) as well as other types of works such as performances, sound recordings and communication signals.
In order to promote the commercialization and manufacturing in Quebec of innovations designed by businesses, the Québec government announced in its 2016-2017 budget the introduction of a deduction for innovative companies. Effective January 1, 2017, the deduction will allow companies in the manufacturing sector, who market a product incorporating a patent protecting an invention developed in Quebec, to benefit from a reduction in their tax rate on their income attributable to this product. patent. The income tax rate for a patent, which should have been 11.8%, will be reduced to 4.0%.
